On the 11th date of February 2003, while waiting in my cell [deleted] here at the United States Penitentiary at Leavenworth.  I was called down to the Officers Station, then told me that some one at the Lutenit’s Office, whanted to speak to me.  this was aprox 8:05 Am (note move was over)

I walking down three flights of stairs, went threw the two Metal detectors, after being cleared, and the Office of the Lutenit, and the Control otherwise known as “Center Hall”, received the radio call I was “Enroute from B-Upper to Lt.’s Office”, and an Ok, was returned.

Upon my “noticed”, arrival in the frount of the Lutenits Office I noticed a Red colored sign, it stated “No Inmates Beyond This Point” Unless Escourted by Staff”.  I awaited watching one Lutenit walk by, he stated nothing.

A few munutes past, then a yelling Lutenit Semick came (alone), walking out into the hall, to the door where I was awaiting escourt.  Lt. [deleted] began yelling “What the hell are you doing here?”, “You just do not know how to do time do you?”, I then replied, “I was called down here, I did not come down here to talk to anyone, I was called here, If you do not need me I will go back to my cell tehn to work, if you do not know why I was called.”

The Lt. [deleted] then stated “ I know why you’re here you’re here to cause problems for one of my Officers, Officer [deleted] isn’t it, he is the one who you accused last few weeks wasn’t it”?

I stated, “I did not come here on my known, and that matter is being investigated, I don not whant to talk to you about this”.

He said” You know what I will show you what” “assault is come here”, he then reached to his back and grabbed for his hand cuffs, and reached for my arm, I pulled away, he again grabbed for my left arm, I again pulled away, then he reached again and caused “deep”, scrach marks in my left arm, and bleeding.  Then I waws forced to punch him in the nose, out of self defense.

I was then taken to the floor by officers, and the Captain, placed in hand cuffs, then charged with assult, I filed a report with SIS against this Officer but the same day, they reported that they covered it up.

I filed a Grievance against BOP, they claim that the Captain did not call me to his office, (after the assult the Captain interviewed me and stated that he had called me to the Office, but could not rember why.

But the grievances stated claim this never happened but he Captain Cajal, claims this never came to his attention and he talked to no body.

I now await final Central Complaint to file 2241, or 1331, in few months, enough is enough.

On May 18, 2003 the United States Penitentiary was locked down due to the abuse by the staff forcing the population to assult staff to defend there selfs, this needs to stop, Colorado had the same problem in 2000, in Colorado, at Florance Prison, also a United States Penitentiary, and a Super Max.
